Bucharest, 20 October 2016 – Societatea Română de Televiziune, represented by Mușat & Asociații, has finally won the trial initiated by a natural person who requested the court to restore the ownership right on the land on which Televiziunea Română is located.
After more than 5 years from the outset of the trial, Bucharest Tribunal dismissed the second appeal filed by the opposing party against the decision rendered by the first court of law, by which the request for the restoration of the ownership right on the land where the headquarters and the studios of the Television are located had been rejected, this resolution remaining thus final.
“The decision of the courts of law in this case is beneficial for Societatea Română de Televiziune in the context of the highly complex issues regarding the restoration of the ownership right of the buildings abusively taken by the communist regime, but also of the numerous enactments regulating this area of practice. We are glad that we succeeded in preventing the risk of losing the land on which the Television is located, which would have had a really serious impact on the activity carried out by the public service television.”, stated Dr. Gheorghe Buta, Co-Managing Partner Muşat & Asociaţii.
The team that represented Societatea Română de Televiziune in this litigation was coordinated by Dr. Gheorghe Buta (Co-Managing Partner Muşat & Asociaţii) and was made up of the attorneys Andra Mihalache (Senior Associate Muşat & Asociaţii) and Coralia Alecu (Associate Muşat & Asociaţii).
The victory of Muşat & Asociaţii is part of a long line of important achievements obtained for Societatea Română de Televiziune, among which, most recently, also the international commercial arbitration conducted before the Arbitral Tribunal in California. That was won this year by Muşat & Asociaţii against New Films International Inc. that issued claims in amount of EUR 5 million.
