MUȘAT & ASOCIAȚII litigation team succeeds to maintain the classification as a historical monument for “Vasile Alecsandri” Memorial House from Bacau

Bucharest, 21 June 2018: The litigation team of MUȘAT & ASOCIAȚII law firm won in court, by a final ruling, a case with special cultural resonance after supporting “Vasile Alecsandri” Cultural and Scientific Society from Bacau and the Ministry of Culture and National Identity in maintaining the classification as historical monument for “Vasile Alecsandri” Memorial House.

The panel of three judges of the High Court of Cassation and Justice rejected the claim filed by the current owner regarding the annulment of the classification as a historical monument of “Vasile Alecsandri” Memorial House, thus maintaining the property under the protection established under Law no. 422/2001 on the protection of historical monuments.

The “Vasile Alecsandri” building was classified as a historical monument as early as in 1991 under Order no. 2314/2004, which continued to include the list of buildings classified as historical monuments during 1991-1992. For over five years, the local civil society and media representatives have extensively debated the disastrous situation of this building included in the cultural patrimony list and campaigned for the continuity of its classification as a historical monument in order to protect the building and to maintain the pre-emptive right of the Romanian state. Pursuant to the law, the county directorate for culture “initiates, when necessary, or requests the county council to expropriate for public utility purposes certain historical monuments in order to save them from destruction and degradation”.

Professor Ioan Dănilă is one of the most fervent defenders of this cultural patrimony building and the founder of the cultural association bearing the name of the poet: “Vasile Alecsandri” Cultural-Scientific Society. Through an official letter, signed together with the principal of “Vasile Alecsandri” University of Bacau, prof. Dr. Carol Schnakovszky, he thanked the team of lawyers who contributed to this success:

“We would like to express our deepest thanks for the manner in which Muşat & Asociaţii law firm chose to involve itself, pro bono, in this dispute. The law firm’s action may be considered, without any exaggeration, as one of those steps aimed at restoring the Romanian patrimonial values”.
