Otto Wolff America Inc., Thyssen Krupp Steel Beteiligungen GmbH, Otto Wolff Handelgesellschaft GmbH and Cideco SA win the trial against Metalexportimport

Muşat & Asociaţii and Nestor Nestor Diculescu Kingston Petersen (NNDKP), the leading Romanian law firms, gladly announce that the High Court of Cassation and Justice finally put an end to the 25 year long trial by irrevocably rejecting the action filed by SC Metalexportimport SA against Otto Wolff America Inc., Thyssen Krupp Steel Beteiligungen GmbH, Otto Wolff Handelgesellschaft GmbH and Cideco SA companies. The scope of the dispute was the action filed by Metalexportimport claiming payment of damages amounting to USD 37.5 million, representing the equivalent value of 68,246 tons of thick plate delivered, allegedly not paid by the abovementioned four companies, as well as the related interest.

Muşat & Asociaţii defended the interests of Thyssen Krupp Steel and Otto Wolff America, while NNDKP represented Otto Wolff Handelgesellschaft GmbH.

The trial commenced on 30 December 1983, was conducted, along the years, by some of the best attorneys in Romania: Constantin Vişinescu, Gheorghe Muşat, Ion Nestor and Ana Diculescu-Şova.

In the past eight years, the dispute was on the dockets of the High Court of Cassation and Justice, and almost every remedies at law possible, including a second appeal for annulment and two challenges for annulment, were resorted to. in the end the supreme final court irrevocably ordered that S.C. Metalexportimport S.A.’s claims are not grounded, thus ruling in favor of the three foreign companies.

The professional cooperation together with the fair and open communication between the two law firms closely contributed to the successful settlement of one of the most complex files in the archives of Romanian legal practice.
